Consequences and Key Considerations in the Light of Arbitration and Adjudication Proceedings

A construction contract usually ends once the acceptance certificate is signed and final payment is made. However, it is not uncommon for the construction contract to be terminated prematurely either by the client or by the contractor. The reasons for such early termination are manifold and their consequences are usually far-reaching. In most cases such situation leads to legal disputes. These cases typically have everything at stake: the allocation of risks in the contract, costs for completion of the project, delay costs, loss of profit, drawing don on guarantees and claims for liquidated  damages.  Our event provides an overview of the main points of dispute between the parties, both from a legal perspective and with regard to the then necessary determination of the quantum. Both German law and the relevant FIDIC clauses will be looked at. Furthermore, we will discuss how adjudication and arbitration proceedings can make a huge difference on the issues at stake, especially compared to lengthy proceeding at state courts.
